In February’s CITMA Review, Oliver Tidman comments on the UKIPO’s decision on Chris Howard’s invalidation action to Bradley Jean-Pierre’s trademark application for MONSOON TEA (O/501/17).

Whilst MONSOON TEA was found to be descriptive of the characteristics of the goods in question, average consumers consisting of the tea industry itself were a key consideration in the Hearing Officer’s decision.
